HLKProductions Terms Of Service


Upon ordering any commission, It is assumed that you have read, and agreed, to the TOS in this document. Content within an order will be treated as such.


The following are terms of service for HLKProductions/@IvieMcKivie, applying to all personal and business transactions, and outlining the acceptable and expected conduct when working with the artist. These terms are here to protect all parties involved, in any and all exchanges.

In contacting and agreeing to receive artwork from me, clients enter a contract with me and agree to all terms on this page, which will not be superseded by any other terms unless explicitly agreed upon by myself and the client.

Where there are multiple character owners per image, but only one individual purchasing, these terms will extend to the owners of any characters depicted in the image.

In contacting and agreeing to receive artwork from me, the client also agrees and affirms that they are at least 18 years old.

In the cases of a client being under the age of 18 years old, they certify that they have legal guardianship approval for sending payment as well as requesting work from me. This is specifically for the use of Paypal as a method of payment, as 18 years old is the minimum requirement for legal use of that service.

By requesting a commission, you certify that you have read, understood and agreed to my ToS.


Main General


--> No refunds; See 'Payment' section for more information.

--> Prices are not based on "half-body" or "full-body" but on detail; if you ask for a full color bust you will receive more detail to hair, shading, ect. than you would on a full body piece that demands attention to clothing ect.

--> I reserve the right to refuse service to any potential clients, without the requirement of having to state my reasoning.

--> Turnaround time varies but due to COVID and Life responsibilities - ETA of your order can fall into a couple of months, see the 'Timeframe and Cancellations' section for more information.

--> My work is not for commercial use, profit, or editing; See 'Revisions and Image Use' for more information.

--> I reserve the right to use your commission as example work in my portfolio, or for future examples of commission works.

--> Progress sketches will be given upon request for larger-scale pieces; Commissions of the 'Sketch' variety do not have this option.

--> If your commission requires more than 1 major change an additional fee depending on the change may be charged; See 'Revisions and Image Use' for more information.

--> If you need your commission within a certain time there are additional fees that vary depending on the crunch time; See 'Payment' for more information.

--> Please be aware that a good portion of commissions are sent to clients privately and not on my social medias; and that most if not all art I post online are personal pieces unless requested by the client after the fact. The activity of my posting activity has no correlation with my work. Please keep this in mind when considering me for commissions.


References and Contact


--> Commissions will only be accepted through clients contacting me either through my email [email protected] or through DMs on Twitter @IvieMckivie - All others will be either redirected or unwillingly ignored (These are the only places I will check often for client communication.)

--> References must be at least 90% visual; This can include color pallets from Google, IRL images for poses or outfit designs, or Mainstream animated media. - I will not accept reference that is another artist's OC or Character.

--> You MUST have your references compiled in an easily legible manner. Through Imgur, Sta.sh, Google Drive, or any other manner that ensures that your refs are together for me to go through. Do not send them to me single file in Twitter DMs.

--> There is an extra charge for non-visual references


Payment


--> The payment process will always be through Invoice through Paypal in USD format. No other forms of payment are accepted. (No Art Trades, Gift Cards, or Bargaining.)

--> Payment plans are only available for commissions totaling $100 dollars or higher; If the client is in a hard financial situation then there may be some discussion, but it is more likely to be requested you focus on your own situation in that case.

--> All prices, including any quote that has been provided, are non-negotiable. Payments are accepted in USD only.

--> Work on the agreed piece will start once half of the total amount has been paid, the second payment will be given on completion of the Commission - high-quality image delivered through the payment Invoice.

--> No refunds for payment provided. All commission funds are used wholly for my payment of living expenses. In commissioning me you accept this term - and the timeframe of my work - and accept that even if the piece may take a few months that you will not be able to receive any kind of refund.

--> Progress sketches will be given upon request (Commissions of the 'Sketch' variety do not have this option), Changes during these sketches may incur additional fees at the final charge depending on the amount requested for change.

--> If you need your commission within a certain time frame (Such as a Birthday or Holiday) there are additional fees that vary depending on the crunch time; The client is required to inform me of this information before the agreement of the work in order for me to make the time needed for that Crunch, if informed after then it is unlikely it will be completed in that limited time frame.


Revisions and image use


--> Simple commissions, intended to be completed within one sitting, especially totaling under $60 dollars may not include thumbnails or other in-progress images for revision.

--> If your commission requires more than 1 major change (Major being redrawn requirements, from 'Changing Pose' to 'Change in outfit design') an additional fee may be charged depending on the change, the client will be informed of this upon their request of that change.

Smaller changes may not be charged, but again, is dependent on the amount requested.

--> Works are not consistent in canvas size - if the client wishes the work to be within a certain size for print I must be informed upfront and before the sketching process (As the canvas size and dimensions will affect the layout of the piece.) Cannot be changed after work has been started.

--> Any piece provided and made by me are not to be taken and made a profit off of by any circumstances. This includes things such as selling personal prints, image packs, and various other merchandise with the image on it.

The only exceptions to this rule are prints for personal use and as Non-profit gifts. Clients may also edit and change the artwork to make icon’s, wallpapers and other graphics to be used non-commercially but are not allowed to alter the art itself.

--> Credit within altered works (Icon, Wallpaper, Background, Stream overlays, Non-profit uses etc) must always be present on either the image itself, or within text in easy recognition.


Cancellations


--> If the client cancels their commission during or after the first payment no refund will be given. No refunds will be given upon final completion either.

--> Cancellation of Commission must be before payment is given, first payment is similar to a 'downpayment' for my time, work, and slot that could have been for someone else's work.

--> If I am the one to cancel the commission, the payment will be refunded to the client. I can cancel and refund a commission for reasons including but not limited to:

---- Rude or inappropriate behavior.

----- Unforeseen inability to complete the commission.

When a commission is canceled before it is complete, the client may keep the incomplete art. I still hold copyright to the art, and left-over art may not be altered or completed by another without permission.

Even for commissions that are not canceled, I may recycle sketches/thumbnails that were rejected by the client for other works.

I may turn down requests to draw a character that does not belong entirely to the client. If you ask me to draw someone else’s character, I may ask that the owner contact me and give me permission to do so, and they must understand at least the general idea of what’s being drawn.

If the commission is intended to be a surprise or gift, I may refuse if I have any suspicion the character is being used without the owner’s consent or otherwise against their wishes.

In order for me to accept your application, you will require the word "Juicyfruit" to let me know you have read and understood these terms of service.
